Terms of Service
These Terms of Service ("Terms") are an agreement between you and Neu Software LLC, a limited liability company organized under the laws of the State of Delaware, United States ("Build Me An App", "we", "us", or "our"). They govern your use of the Build Me An App mobile application, the website at buildmeanapp.xyz, and related services (together, the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind it to these Terms.
2. What Build Me An App does
Build Me An App generates small software applications ("Apps") from your spoken or typed descriptions, runs them inside the Build Me An App application, stores them and their contents for you, and lets you change them. Apps are generated by artificial-intelligence models and may contain errors, may not work as you intended, and may behave differently after a change. Review what Build Me An App makes before relying on it.
3. Your account
An account is created automatically on your device the first time you use the app. You are responsible for the device and for everything done through it. Keep your device secure. We may suspend or terminate accounts that violate these Terms.
4. Your content and your Apps
You keep all rights to the ideas, text, recordings, files, and data you provide ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Your Content only as needed to provide the Service, including sending it to the AI and hosting providers described in the Privacy Policy.
To the extent we hold any rights in the code Build Me An App generates for you, we assign them to you, and you may copy, download, modify, and use your Apps for any purpose. Generated code may resemble code generated for other users from similar requests; no user has an exclusive right to such similarities.
You represent that you have the rights needed to provide Your Content and that it does not violate any law or third-party right.
5. Acceptable use
You agree not to:
- use the Service to create or distribute content that is illegal, infringing, harassing, hateful, or that exploits minors;
- attempt to extract, reverse engineer, or interfere with the Service, its models, or other users' data;
- use automated means to access the Service beyond what the app itself does, or circumvent usage limits;
- use the Service to build anything that requires it to be error-free, such as medical, legal, financial, or safety-critical tools;
- resell the Service without our written permission.
6. Plans, prices, and payment
The Service is currently free while in early release. We may introduce paid plans ("Build Me An App Plus"). If we do, prices, billing periods, renewals, and cancellation will be shown before you buy, purchases will be processed by the Google Play or Apple App Store billing systems, and their refund policies will apply. Where a plan selection is shown in the app before billing is available, choosing it does not create a charge.
7. Changes to the Service
We are improving Build Me An App continuously and may add, change, or remove features. We may also change or discontinue the Service. Where practical we will give notice and provide a way to export your data.
8. Third-party services
The Service depends on third-party providers (including OpenAI, OpenRouter, Google, Cloudflare, and app-store platforms). Their availability and terms are outside our control. Where required by Apple, you acknowledge that these Terms are between you and us and not with Apple, and that Apple has no obligation to provide support for the Service.
9. Intellectual property
The Build Me An App application, website, brand, and everything we provide other than your Apps and Your Content are owned by Neu Software LLC or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the app on devices you own or control, subject to these Terms.
10. Disclaimers
THE SERVICE AND ALL APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED APPS WILL BE ACCURATE, SECURE, OR SUITABLE FOR ANY PURPOSE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEU SOFTWARE LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR FIFTY US DOLLARS (US$50). Some jurisdictions do not allow these limitations, so they may not apply to you.
12. Indemnity
You will defend and indemnify Neu Software LLC against claims arising from Your Content, your Apps, or your violation of these Terms or of any law.
13. Termination
You may stop using the Service and delete your account at any time (see Delete your account). We may suspend or terminate your access if you breach these Terms or if required by law. Sections that by their nature should survive termination will survive.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute that cannot be resolved informally is the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any rights you have as a consumer under mandatory laws of your country of residence.
15. Changes to these Terms
We may update these Terms. We will post the new version here and update the dates above, and for material changes we will notify you in the app before they take effect. Continued use after the effective date means you accept the updated Terms.
